Employer of record services in Canada for U.S. companies

An employer of record legally employs a worker on another company's behalf. InfraDev is that employer in Canada: we hire the person you choose, run payroll and tax remittances, and handle employment compliance. You direct the work, and you don't need a Canadian entity.

What does an employer of record do in Canada?

An employer of record in Canada becomes the legal employer of a worker on another company's behalf. The EOR signs the employment contract, runs Canadian payroll, withholds and remits income tax, CPP or QPP and EI, applies provincial employment standards, and issues T4 slips. The client company chooses the person and directs the day-to-day work.

  • Canadian payroll

Payroll run every pay cycle, with accurate calculations and on-time payments.

  • Tax remittances and slips

CPP, EI, QPP and QPIP remittances to the CRA and Revenu Québec, and T4 and RL-1 slips at year end.

  • Labour law compliance

Provincial employment standards and workplace safety coverage, including CNESST in Québec.

  • Employment contracts

Compliant employment agreements that assign work product and inventions to your company.

  • Onboarding and termination

Onboarding, time tracking, and offboarding, including notice, final pay and Records of Employment.

  • Benefits administration

Optional group benefits and day-to-day HR support for your Canadian staff.

Employer of record or your own Canadian company?

An employer of record suits a first hire, a small team or a market test, because there is no Canadian company to form or run. Your own Canadian entity can pay off once headcount and time horizon justify its fixed overhead: incorporation, payroll accounts, filings and local administration.

Opening a Canadian entity compared with hiring through an Employer of Record

With InfraDev as employer of record

  • Hire in Canada without opening a company
  • Payroll and tax remittances managed
  • Employment compliance managed
  • Hires start within 24–48 hours of terms being agreed
  • No local HR or payroll function to run

Opening your own Canadian company

  • Incorporation and registration take months
  • Payroll accounts with the CRA (and Revenu Québec) to open
  • Payroll and tax remittances to run yourself
  • Employment law and compliance to manage
  • HR and administration overhead in Canada

InfraDev's employer of record fee starts as an estimate of 10% of salary (15% above US$200,000), with a minimum of US$499 a month per employee. Salary, statutory deductions and employer contributions are billed at cost on the same monthly invoice. The final fee is agreed with each client and depends on the role and province.

Frequently asked questions

Common questions about hiring through our employer of record.

Is hiring through an employer of record legal in Canada?

Yes. Third-party employment is a recognized model in Canada when structured correctly. Canadian employment law permits a third-party employer to hire workers on behalf of foreign companies. InfraDev employs Canadian workers on behalf of U.S. businesses, in line with applicable law. We do not recruit or employ workers inside the United States.

Do we need a Canadian company?

No. InfraDev acts as the employer of record, so you don't form a Canadian corporation, register with the CRA, or set up payroll accounts. We handle all of that.

How quickly can we onboard a new employee?

Typically within 24–48 hours once we have all required documentation. The exact timeline depends on the completeness of the employee's information and any specific provincial requirements.

Do you hire remote-only workers?

Yes. We specialize in remote employment. Your Canadian employees work from wherever they are located in Canada, and you manage their day-to-day work remotely.

What provinces do you operate in?

We can hire employees in all Canadian provinces and territories. We ensure compliance with provincial labour laws, workers' compensation (CNESST in Quebec), and all regional requirements.

Can you help us find candidates?

We focus on the employment and compliance side. You find the candidates you want to hire, and we facilitate the legal employment process. We are not a recruitment agency.

What about immigration sponsorship?

We do not provide immigration sponsorship (TN, H1B, etc.). We only offer Canadian-based employment for workers who are already legally authorized to work in Canada.

What happens if we need to terminate an employee?

We handle all termination processes including Record of Employment (ROE) generation, final pay, and compliance with provincial labour laws regarding notice periods and severance.

Can our hire work from an office?

Yes. InfraDev has office space in Beaconsfield, Québec, and staff employed through our EOR can work there up to five days a week. Where your security requirements call for it, access to systems or data can be limited to our office. See Host your hire.

InfraDev employs people in Canada and provides Canadian labour compliance. We do not provide U.S. employment, immigration sponsorship, or legal or tax advice.
